Legal Problems in the Regulation of the Lands of the Cessation of Allotments Under the Legislation in Force in the West Bank

Objectives: The endowment lands, particularly the allotments of Amiryah lands, are distributed across the West Bank. Many endowment authorities have ceased to exist, yet the existing legislation still preserves this ancient legacy. This situation has led to confusion between the legitimate endowments and the authentic Amiryah lands. This research aims to be one of the few studies that focus on this topic, clarifying the legal status of this type of land and its associated legal provisions.
Methods: The study adopted a descriptive analytical approach, explaining the legal system for endowment of allotment lands within the framework of the legislation in force in the West Bank. Analyzing the historical approach to the statement of its origins and the relevant legal texts to address the research problem.
Results: The study concluded that the suspension of allotment lands is rooted in Ottoman land law and represents a form of princely land. It highlights that the role of endowments within this context pertains to fees, taxes, and other allowances that benefit the endowment authorities. This is a right akin to personal rights that have taken on the status of franchise rights.
Conclusion: The study recommends canceling this form of land due to the extinction of most endowment areas and the continued restrictions on the land, which adversely affect the rights of disposers in several locations.
