The Extent of Criminal Response to Deepfake Under the Jordanian Cybercrime Law No. 17 of 2023: A Comparative Analytical Study

Objectives: This study examines the emerging phenomenon of deepfake crimes associated with artificial intelligence and evaluates how the Jordanian Cybercrime Law No. 17 of 2023 addresses them.
Methods: The study adopts an analytical approach by presenting and analyzing doctrinal opinions and applying general and specific legal provisions to the crime of deepfake.
Results: The findings indicate that Arab criminal laws, including Jordanian legislation, have not established explicit legal provisions that regulate the use of deepfake technology. They also fail to address the responsibility of entities producing or operating this technology. Consequently, both the criminal acts and the role of service providers remain insufficiently regulated. Preventive and remedial measures are largely absent, unlike European and Chinese legislation, which explicitly criminalize such acts and regulate preventive procedures.
Conclusions: The study recommends introducing a specific criminal provision in the Jordanian Cybercrime Law stating: “Without prejudice to any more severe penalty stipulated under any other law, anyone who uses deepfake technology with the intent to commit any crime stipulated in this law or any other punishable offense shall be punished by imprisonment for a period of six months to three years and a fine of not less than 2,000 JOD and not exceeding 5,000 JOD, or both.” It also recommends obligating entities producing and operating this technology, including service providers, to implement safeguards preventing misuse and to report deepfake-related activities to the authorities..
