The Extent to which States are obligated to Implement International Commercial Contracts during International Conflicts: The Russian-Ukrainian Conflict as a Model

Objectives: This study aims to demonstrate the extent to which force majeure and the theory of emergency applies to contractual obligations in light of the Russian-Ukrainian war and the extent to which Article 79 of the Vienna Convention of 1980 is implemented regarding contracts for the international sale of goods.
Methods: An analytical approach was adopted by analyzing emergency conditions and projecting them onto international trade contracts. A descriptive approach was used through a precise description of the stages of international commercial contracting under force majeure, and a comparative approach was used by comparing some Arab legislation with international agreements.
Results: The rules of international commercial contracts are not sufficient to address the impact of armed conflicts and changing circumstances on these contracts. It is difficult to distinguish between the theories of force majeure and emergency circumstances, which leads to difficulty in reaching the applicable theory, as the Russian-Ukrainian war resulted in negative effects on the economies of countries in general, and the application of either of the two theories to the Russian-Ukrainian war differs according to the contract concluded.
Conclusions: It is necessary for both parties to a contract to set specific clauses that deal with cases of force majeure, to ensure that international trade contracts are not invalidated, set more accurate international trade contracts to avoid chance during implementation, and implement amicable solutions when problems arise in the implementation of commercial contracts before resorting to international courts.
