Electronic Scientific Publishing in Algeria between Evolution and Legal Deficiency: A Comparative Study

The era of digital language has changed many aspects of life, the importance of electronic scientific publishing has emerged and it has gained a distinguished position because the progress of countries has become measured by increasing the rates of international publication of scientific research. However, the information and communication technology revolution has brought profound changes in the issue of copyright protection, especially with the emergence of the concept of Open Access and the ease of publishing, circulation, and reproduction of creations and their wide dissemination thanks to electronic encyclopedias and Web 2.0 technologies. Accordingly, forgery and scientific piracy have spread. The study followed the descriptive approach through exposure to various concepts of electronic scientific publishing and its basics and effectiveness, and the analytical approach through the analysis of national and international legal texts, especially in the field of copyright protection, and the extent of keeping up with this field. The study proved the inadequacy of the legal system in Algeria since the 03-05 law on copyright and related rights did not keep pace with the developments of the digital environment, the inconsistency of the term of protection with electronic works, and even the lack of Organization of measures to protect electronic technical methods, non-discrimination between the traditional and digital medium and the absence of provisions. The study recommends a review of intellectual property laws in order to keep up with every new development because literary and artistic works have become an important factor in the economy of countries.
