The Disagreement is Regarding the Determination of a Thing as that of that Thing and its Impact on Islamic Criminal and Legal Jurisprudence

Objectives: The study aims at addressing jurisprudential dispute in considering the resolve to do something with that thing's stature, subsequently applying it to Islamic and legal criminal jurisprudence.
Methods: The study relied on an inductive approach to collect and investigate scientific material theoretically and empirically. Addtionally, a comparative analysis approach was used to edit the research issue, as well as the clarification of the jurisprudence branches resulting from the overriding statement, then appling both approaches to Islamic and legal criminal law.
Results: The study found that determination in worldly judgments is not influential in itself and does not lower the status of a thing unless it is supported by an apparent action; accordingly it considrded influential. This jurisprudential dispute has had an impact on criminal jurisprudence, the most important of which is that the preparatory work for the crime is attached to the stage of determination in the absence of punishment for it, unlike the implementation stage, which goes from the stage of determination to the execution.
Conclusions: The study recommends drawing researchers' attention to the connection between doctrinal issues and the rules of jurisprudence, by pointing out the positive effects of both, leading them out of the state of infertility and the latency period in the prison of theoretical lesson to the state of production. The study also recommends completing the study of the topic and its impact on other parts of jurisprudence.
