Women Military Recruitment in the Islamic Sharia Kuwait as a Model

Abstract

Objectives: This research deals with clarification of the Islamic Sharia view concerning women’s recruitment and work in the military corps, and presented to the clarification of the sharia ruling concerning jihad “struggling” and fighting in the cause of Allah, and the conditions that must be met by the mujahid “struggler” in the cause of Allah, the cases in which jihad is obligatory on every Muslim, and the ruling of jihad for women. Moreover, this research addressed the sharia ruling concerning military recruitment of women in military and combat missions, the legal ruling for their recruitment in support missions for the army service, and the sharia controls for recruiting women in the support services for the army.

Methods: To clarify this, the study used the inductive, analytical and deductive methods.

Results: The research concluded that the Islamic Sharia necessitates the Jihad al-Talab “Offensive Jihad” on free men but not women, so that jihad is not obligatory for women except for necessity, in case of Jihad al-Dafa’ “Defensive Jihad” if the enemy attacks the country. As for the recruitment of women in the army to take up arms and fight the enemies on their land, it is not permissible, unlike the recruitment of women to work in the support services in the army which isn’t contrary to the provisions of Islamic Sharia as it’s admissible by sharia provided that the legal regulations are adhered to.

Conclusions: Women recruitment should be mandatory to teach them self-defense whenever required
