The Scope of Criminal Liability of Political Parties for Vote-Buying Crime in the Jordanian House of Representatives Election Act No. 4 of 2022

Objectives: This study aimed to examine the potential for assigning criminal liability to political parties for the crime of vote-buying, as stipulated in Article 63 of the House of Representatives Election Law No. 4 of 2022.
Methods: The study employed a descriptive and analytical approach to describe and analyze the legal provisions governing this liability under Jordan's Penal Code, the Election Law of the House of Representatives No. 4 of 2022, and the Political Parties Act No. 7 of 2022. Legal jurisprudence and judicial interpretations were also utilized.
Results: The findings revealed that the Jordanian legislature did not include specific provisions on the criminal liability of political parties for vote-buying in either the Election Law or the Political Parties Act. As a result, political parties are subject to the general provisions of the Penal Code. The study highlighted the absence of comprehensive criminal protections in Jordanian legislation to address all forms of voter influence by political parties, as well as the inadequacy of penalties prescribed for such offenses.
Conclusion: The study recommends enacting specific provisions to establish the criminal liability of political parties for vote-buying. These provisions should ensure that the liability of a party’s secretary-general, members, representatives, or workers is not excluded if the crime is committed on behalf of the party or using its resources. Furthermore, it advocates for classifying vote-buying as a felony and a corruption crime.
