The Method of Inductive Reasoning in Islamic Jurisprudence: A Foundational and Applied Study

Abstract

 

Objectives: This study aims to examine the authority of inductive reasoning in Islamic jurisprudence, its role in deriving legal rulings, and the extent to which different Islamic schools recognize it as a valid legal proof.

Methods: The study employs inductive, analytical, and historical methodologies to define induction and assess its significance in Islamic jurisprudence. It also analyzes the legal evidence supporting its authority by reviewing the views of jurists and scholars of Islamic legal theory. The study examines the legal proofs that validate its use by tracking the statements of jurists and legal theorists regarding its application in argumentation and evidence, especially in formulating legal and jurisprudential principles by examining similar cases. Additionally, it clarifies how legal theorists use induction to derive both general and specific objectives of Sharia. The study also focuses on the method used by jurists to establish legal rulings in cases where there is no direct text from the Qur’an or Sunnah, using induction.

Results: The findings indicate that inductive reasoning is widely accepted among Islamic jurists, though the degree of its authority varies across different schools of thought. It is recognized as a crucial tool for establishing jurisprudential principles and understanding the objectives of Islamic law.

Conclusions: The study concludes that inductive reasoning is a credible and valuable method in Islamic legal scholarship. It recommends that further attention be given to this method in Islamic legal education to enhance its application in deriving rulings and legal principles.
