التحليل القانوني لاستخدام الأسلحة الذكية في النزاعات المسلحة استنادًا إلى مبادئ القانون الدولي الإنساني

الأهداف: يهدف البحث إلى بيان مفهوم وأنواع الأسلحة الذكية تمهيدًا لدراسة وضعها القانوني بالنسبة لمبادئ القانون الدولي الإنساني. وتم اختيار الموضوع لحداثته، وبسبب طبيعة الأسلحة القائمة على التطورات المستمرة في أنظمتها، والتي غيرت طريقة تفاعل البشر مع النزاعات المسلحة، واتخاذ قرارات استخدام القوة في العمليات الحربية.
المنهجية: اعتمد البحث المنهج التحليلي، وذلك من خلال تحليل مضمون تلك المبادئ، وقياس طبيعة الأسلحة الذكية عليها، ودراسة مدى امتثالها لقواعد القانون الدولي الإنساني؛ حتى لا يتم انتهاك قواعد القانون بالتعذّر بطبيعة تلك الأسلحة، وآليات استخدامها أو حتى لا يتم إغفال سيادة المبادئ. كما اعتمد البحث المنهج الوصفي، الذي يتعين في وصف حال الحروب ومستقبلها القريب، وبيان جريانها ومستحدثاتها، واختلاف نتائجها بحسب الأسلحة المستخدمة فيها.
النتائج: توصل البحث إلى معيار جديد يستند عليه في تقسيم أنواع الأسلحة الذكية، كما أثبت إلى أنه لا يمكن الاطمئنان إلى ضمان تطبيق الأسلحة الذكية لمقاصد مبادئ القانون الدولي الإنساني، ويجب حظر استخدام الأسلحة الذكية التي من شأنها القيام بالعملية العسكرية من تلقاء نفسها.
الخلاصة: تشمل الأسلحة الذكية الأسلحة المطوّرة وأنظمتها الرقمية، ويوصي البحث نحو دعوة حقيقية لإقرار معاهدة دولية جديدة تحكم التطورات، وتكون مُخصصة لتنظيم الأسلحة الذكية ونُظُم تشغيلها؛ تفاديًا وسدًا للثغرات الموجودة في المعاهدات الحالية. كما يدعو إلى تحديد آلية مساءلة قانونية أكثر ضبطًا ودقة فيما يتعلق بالانتهاكات الناتجة عن استخدام الأسلحة الذكية وأنظمتها.
