الملخص

الأهداف: تأتي هذه الدراسة لتسليط الضوء على الاستئناف التبعي أمام محاكم الاستئناف الشرعية وفقاً لقانون أصول المحاكمات الشرعية، باعتباره وسيلة طعن تحمي المستأنف عليه في الاستئناف الأصلي، والذي يقدمه المستأنف عليه ردا على الاستئناف الأصلي رغم فوات ميعاد الطعن أو قبوله بالحكم الابتدائي في وقت سابق.

المنهجية: اتبعت الدراسة المنهج التحليلي، حيث تم استعراض النصوص القانونية الناظمة للاستئناف التبعي في قانون أصول المحاكمات الشرعية ومقارنتها بالقانون المقارن والاجتهادات القضائية والفقه.

النتائج: انتهت الدراسة الى إن الاستئناف التبعي هو طريق طعن عادي يرد به المستأنف عليه في مواجهة المستأنف بعد فواد الميعاد، ويرفع بالإجراءات المعتادة لرفع الاستئناف الأصلي أو بمذكرة مشتملة على أسباب استئنافه، وذلك خلال عشرة أيام تلي تاريخ تبلغه لائحة الاستئناف الأصلي. ويتبع الاستئناف الأصلي وجودا وعدما، فيرفع الاستئناف التبعي إما بلائحة استئناف تخضع للقواعد العامة للائحة الاستئناف الأصلي أو بمذكرة خطية مشتملة على أسبابه.

الخلاصة: خلصت الدراسة إلى ضرورة أن ينص صراحة على إعفاء الاستئناف التبعي من الرسوم، وإن يرد على محل الاستئناف الأصلي أو تقيده بإطراق الاستئناف الأصلي.
