النشر العلمي الإلكتروني في الجزائر بين مطرقة التطور وسندان القصور القانوني: دراسة مقارنة

غيّر عصر الّلغة الرقمية الكثير من جوانب الحياة، فبرزت أهمية النشر العلمي الإلكتروني و حظي بمكانة متميزة لأن تقدم الدول أصبح يقاس بزيادة معدلات النشر الدولي للأبحاث العلمية. لكن بالتزامن، أحدثت الثورة المعلوماتية وتكنولوجيا الاتصالات تغييرات عميقة في قضية حماية حقوق المؤلف خاصة مع ظهور مفهوم النفاذ المفتوح Open Acess وسهولة نشر وتداول واستنساخ الابداعات ونشرها على نطاق واسع بفضل الموسوعات الالكترونية وتقنيات الويب 2.0، فانتشر التزوير والقرصنة العلمية. اتبعت الدراسة المنهج الوصفي من خلال التعرض لمختلف المفاهيم الخاصة بالنشر العلمي الإلكتروني وأساسياته وفاعليه، و المنهج التحليلي من خلال تحليل النصوص القانونية الوطنية والدولية خاصة في مجال حماية حق المؤلف، ومدى مواكبتها لهذا المجال . أثبتت الدراسة قصور المنظومة القانونية في الجزائر وذلك لعدم مواكبتها الأمر 03-05 المتعلق بحقوق المؤلف والحقوق المجاورة تطورات البيئة الرقمية، وعدم تماشي مدة الحماية مع المصنفات الالكترونية، بل وانعدام تنظيم تدابير لحماية الأساليب التقنية الالكترونية، وعدم التمييز بين الوسط التقليدي والرقمي وغياب أحكام تتعلق بعقوبات التنزيل غير المشروع للمصنفات المنشورة إلكترونيا. توصي الدراسة بإعادة النظر في قوانين الملكية الفكرية لكي تبقى مواكبة لكل تطور جديد، لأن المصنفات الأدبية والفنية أصبحت تشكل عاملا مهما في اقتصاد الدول.
