الفسخ الجزائي لعقد الامتياز والأشغال العامة والتوريد في القانون الأردني: دراسة مقارنة

الملخص

الأهداف: تهدف هذه الدراسة إلى بيان موقف المشرع والقضاء الأردني من الفسخ كجزاء لعقد الامتياز، وعقدي الأشغال العامة والتوريد من خلال اعترافهما للإدارة بِسلطة الفسخ الجزائي، وإخضاع هذه السلطة للرقابة القضائية باعتبارها ضمانة ضد تعسفها.

المنهجية: اعتمدت الدراسة المنهج التحليلي الوصفي المقارن حيث تم دراسة وتحليل النصوص القانونية والأحكام القضائية الأردنية ذات العلاقة، ومقارنتها بموقف التشريع والقضاء الفرنسي والمصري للوصول إلى نتائج عَملية ومتماشية مع مُتطلبات هذه الدراسة.

النتائج: توصلت الدراسة إلى أن المشرع الأردني والفرنسي والمصري لم يمنح أطراف العقد الحق بالطعن بالإلغاء بقرار فسخ العقد الإداري، وفيما يتعلق بالغير قد مكنه القضاء الأردني والمصري من الطعن بالإلغاء على القرارات الإدارية الصادرة في المرحلة التمهيدية للعقد، دون القرارات الصادره تنفيذاً للعقد، خلافاً للقضاء الفرنسي الذي أجاز للغير الطعن بالالغاء على جميع القرارات المتعلقة بالعقد الإداري.

الخلاصة: توصي الدراسة المشرع الأردني إيراد نص مادة في قانون القضاء الإداري يَسمح من خلاله للمتعاقد مع الإدارة الطعن بقرار فسخ العقد الإداري بالإلغاء، لما فيه من تحفيز للأفراد للتعاقد مع الإدارة
