تهدف الدراسة الى بيان أن لمصالح العباد أثر في تغير الاحكام حيث ان الشريعة الإسلامية جاءت لتراعي مصالحهم المعتبرة شرعا. و تعالج هذه الدراسة أثر المصلحة في تغير الاحكام الشرعية. اعتمد الباحث المنهج الاستقرائي لاستقراء أقوال الاصوليين من كتبهم المختلفة و المنهج الوصفي لتتبع الأحاديث الشريفة التي تثيت تغير الاحكام تبعا لتغير المصالح والمنهج التحليلي في تحليل وتفسير وتوجيه الآيات القرآنية والاحاديث الشريفة الخاصة بهذه المسألة. توصلت الدراسة الى ان الشريعة كلها مبنية على المصالح إما جلب منفعة أو درء مفسدة. وأن الاحكام التي تتغير هي الاحكام المرنة، وأما الثابتة فلا سبيل لتغيرها حتى قيام الساعة و أن هذا التغير لا يكون إلا عن طريق المجتهد الجامع لشروط الاجتهاد. توصي الدراسة بأهمية الاهتمام بكليات الشريعة ودوائر الافتاء والمجامع الفقهية بالدراسة التفصيلية التطبيقية؛ لمرعاة المسائل التي يتغير احكامها بتغير المصالح، ونشرها للعامة وحث طلاب الدراسات العليا على تخصيص البحث فيها.
