تعد الحماية الجنائية للملكية الفكرية من الموضوعات التي زاد الاهتمام بها في محاولة لحماية هذا الحق لأنه من الحقوق التي تعطى للأشخاص مقابل إبداعاتهم الفكرية، ومنع الآخرين من استغلال هذا الحق، وقد عمدت هذه الدراسة في فقراتها إلى معالجة الحماية الجنائية للملكية الفكرية في محاولة منها لتبيان جميع الأطر القانونية المنظمة لهذا الحق لحمايتها وفقًا للقوانين الدولية وكذلك الوطنية - الفلسطيني والعماني-، لمعرفة مدى فعالية هذه الأطر في تكوين إطار قانوني يقضي إلى حماية هذا الحق. فقد استعان الباحث في تحليله بعدة مناهج كالوصفي والتحليلي، من أجل وصف جميعجميع الجرائم والعقوبات المقررة في النصوص القانونية الدولية والوطنية وتحليلها للخروج بحلول واقعية تساعد على حل إشكالية البحث الرئسية. ومن هنا خلصت الدراسة إلى ضرورة العمل على الاستجابة إلى الاتفاقيات الدولية نظرًا لنقص التشريعات الوطنية في مواكبة القوانين الدولية، لذلك أوصت الدراسة بضرورة تعديل التشريعات الفلسطينية، أما التشريعات العمانية فتجد الدراسة أن التشربعات الصادرة في هذا الشأن كافية بعد أن اتخذت السلطنة مجموعة من الإجراءات وسنت التشريعات إلى جانب تعديلها للعديد من القوانين. .
