قاعدة "الغاية تبرّر الوسيلة" في موازين الشريعة

تناولت هذه الدراسة موضوع قاعدة "الغاية تبرّر الوسيلة" لبيان مدى اتفاق هذه القاعدة أو تعارضها مع الشريعة الإسلامية، وقد جاءت الدراسة في مبحثين، فتحدثت في المبحث الأول عن تعريف القاعدة من خلال تعريف مفرداتها أولاً، ثم تعريفها مصطلحاً مركباً، وبيان نشأة هذه القاعدة ومصدرها، وبينت الدراسة موقف الشريعة الإسلامية من القاعدة، وفي المبحث الثاني ذكرت الدراسة أمثلة تطبيقية من الشريعة الإسلامية لبيان أوجه الاتفاق، والاختلاف مع القاعدة. لتحقيق اهداف الدراسة استخدمت الدراسة المنهج الاستقرائي من خلال تتبع أقوال الفقهاء القدامى والمعاصرين، ثم تحليل هذه الأقوال والمذاهب بعرضها على موازين الشرع ومقاصد التشريع، وبالتالي الوصول إلى نتاجات هذا التحليل. وقد خلُصت الدراسة إلى أن الغايات تؤثر في وسائلها، وبناء على ذلك فإن قاعدة "الغاية تبرر الوسيلة" بغض النظر عن السبب الذي وضعت لأجله لا تتعارض بشكل مطلق مع الشريعة الإسلامية، فهناك قواعد وأحكام فقهية كثيرة تتفق مع هذه القاعدة، وبيّنت الدراسة الضوابط الشرعية التي يجب توافرها للعمل بقاعدة "الغاية تبرّر الوسيلة".
