تسوية النزاع المصري الإثيوبي حول مشروع سد النهضة: بين عدم الكفاية في قواعد القانون الدولي، وتعذر التطبيق

المقالة تهدف إلى البحث عن إمكان إيجاد تسوية لهذا النزاع المصري الإثيوبي، وذلك بمناقشة وتحليل عدد من الاتفاقيات غير متعددة الأطراف حول نهر النيل في ضوء كل من اتفاقية فيينا لقانون المعاهدات لسنة 1969م، واتفاقية فيينا لخلافة الدول في المعاهدات لسنة 1978م، كما سوف يتطرق الباحث في هذه المقالة إلى القانون الدولي العرفي للأنهار الدولية. أن الباحث في هذه المقالة ينتهي إلى أنه من الصعب إيجاد تسوية للنزاع المصري الإثيوبي؛ كون قواعد القانون الدولي ذات العلاقة بالنزاع إما أنها غير كافية لتسوية النزاع لتضمنها معايير غامضة ومرنة، أو أنها غير قابلة للتطبيق بسبب الدول أطراف النزاع نفسها. ويوصي الباحث في هذه المقالة أن أية تسوية للنزاع المصري الإثيوبي يجب أن تكون مؤسسة على التوفيق بين موقفي طرفي النزاع، وهذا التوفيق قد يجد ضالته في قاعدة "الانتفاع المنصف وعدم الاضرار بالغير" المنصوص عليها في اتفاقية مبادرة حوض النيل المتبناة عام 1999م. غير أن هذا القاعدة تحتاج إلى عدد من المعايير حتى يتسنى تطبيقها على النزاع المصري الإثيوبي.
