تبرز أهمية هذا البحث من خلال بيان أحكام الحضانة في المذهب المالكي، من بيان تعريف أحكام الحضانة، و ترتيبها، والشروط التي يجب توافرها في الحاضن، والأحكام المتعلقة بالمحضون من نفقة، ورؤية، وسفر، مع ذكر حالات إسقاط الحضانة، ووقت الانتهاء، مع مقارنتها بقانون الأحوال الشخصية الكويت. وقام البحث على المنهج الاستقرائي من خلال استقراء كتب الفقه المالكي وما جاء فيه من أحكام الحضانة، والمنهج المقارن من خلال مقارنة أحكام الحضانة عند المذهب المالكي، وما جاء في قانون الأحوال الشخصية الكويتي من أحكام الحضانة، والمنهج التحليلي من خلال دراسة مفهوم أحكام الحضانة، ثم بيان ما يتعلق بها من أحكام، جاء بها قانون الأحوال الشخصية الكويتي، ويخلص البحث إلى بيان دور الشريعة الإسلامية على الأسرة المسلمة، من خلال الأحكام الشرعية التي تحفظ للفرد حقوقه، ومنها أحكام الحضانة التي تكفل حق المحضون حال صغره، وإلى بيان دور الكويت في المحافظة على حقوق المحضون، من خلال حرصها على الالتزام بأحكام الشريعة الإسلامية في سن قانون الأحوال الشخصية الكويتي.
