تعليق على قرار المحكمة الإدارية السورية: رقم /351/ لعام 2019

الأهداف: تهدف هذه الدّراسة إلى التعليق على قرار المحكمة الإدارية السورية رقم /351/ لعام 2019، وتحديد أوجه القوة والضعف فيه لجهة النقاط التي أثارها القرار، وبيان مدى توافقه مع الاجتهاد الفقهي والقضائي.
المنهجية: اعتمدت الدراسة على المنهج الاستنباطي بعد مراجعة عدد من القرارات القضائية المتصلة بالقرار محل التعليق.
النتائج: توصلّت الدراسة إلى أنّ الاختصاص الأصيل في تحديد نطاق أعمال السيادة يعود للقضاء، وضرورة عدّ هذه الأعمال كاستثناء من أصل عام يقوم على اختصاص القضاء بالنظر في جميع المنازعات الإدارية. كما توصّلت الدراسة إلى أنّ سلطة التقدير الإدارية تَرِد على عناصر محددة في القرار، ولا يمكن أنْ تكون هذه السلطة دون قيود أو رقابة قضائية، وإنَّ الأعمال الإدارية التي تكون مُناطةً بلجانٍ فنيّةٍ متخصصةٍ وما تتوصل إليه من نتائج يُمثّل مساهمةً رئيسيةً منها في اتحاذ القرار النهائي.
الخلاصة: خلصت الدراسة إلى ضرورة مواكبة التطورات القضائية لأعمال السيادة، وحرية التقدير التي تتمتّع بها الإدارة، من خلال إعمال رقابة الخطأ البيّن التي من شأنها إدخال جميع التصرّفات التقديرية في الرقابة القضائية.
