الملخص

الأهداف: تهدف هذه الدراسة إلى بيان طبيعة وحدود رقابة القضاء الأردني على قرار التحكيم، وتحديد أسباب رفع دعوى بطلان قرار التحكيم من خلال استعراض قانون التحكيم الأردني وأحكام المحاكم وقواعد الأونسيترال للتحكيم واتفاقية نيويورك المتعلقة بقرارات التحكيم الأجنبية وتنفيذها.

المنهجية: اعتمدت الدراسة على المنهج الوصفي التحليلي، من خلال استقراء وتحليل نصوص قانون التحكيم الأردني وقانون أصول المحاكمات المدنية الأردني وبعض الاتفاقيات الدولية المتعلقة بالتحكيم، واستعراض أحكام المحاكم في الأردن كتطبيقات قضائية متعلقة في أسباب دعوى بطلان قرار التحكيم وتنفيذ قرار التحكيم.

النتائج: توصلت الدراسة إلى أن رقابة القضاء الأردني على قرار التحكيم تكمن في صورة دعوى بطلان وفقاً لأسباب حددها المشرع الأردني على سبيل الحصر، مع تقيد مبدأ سلطان الإرادة معتبر الرقابة على التحكيم رقابة ذات طابع وقائي وعلاجي في آن واحد، وتنفيذ قرار التحكيم الوطني والأجنبي يتم بإضافة الصيغة التنفيذية من المحكمة المختصة.

الخلاصة: ضرورة العمل في التعديلات التشريعية الجديدة على تعديل الأحكام المتعلقة بتحديد أسباب الرقابة السابقة واللاحقة لصدور قرار التحكيم، خاصة في استمرارية المحكمة في النظر في الدعوى إذا طلب الخصوم الاستمرار في الدعوى بغض النظر عن شرط التحكيم.
