المعاملة المتساوية لمستخدمي المنازل: القانون القطري والقانون الدولي

الأهداف: يهدف هذا البحث إلى دراسة حقوق والتزامات مستخدمي المنازل في القانون رقم (15)، لسنة 2017 المتعلق بمستخدمي المنازل في قطر بالمقارنة مع الأحكام الواردة في اتفاقية مستخدمي المنازل رقم 189 لسنة 2011 الصادرة عن منظمة العمل الدولية. كما يهدف إلى تسليط الضوء على مبدأ المعاملة المتساوية بين عمال المنازل والعمال العاديين، والذي أرسته الاتفاقية الدولية رقم 189.
المنهجية: اتّبعت الدراسة منهجا وصفيا تحليليا مقارنا، حيث تم استعراض النصوص القانونية وتحليل مضمونها، وبعد ذلك مقارنتها على مستويين؛ المقارنة بين أحكام القانون الوطني والاتفاقية الدولية من ناحية، ومن ناحية أخرى المقارنة بين القانون القطري رقم (15) الخاص بعمال المنازل، وقانون العمل القطري.
النتائج: توّصلت الدراسة إلى مجموعة من النتائج، أهمها أنّ القانون القطري كان ولا يزال يستثني مستخدمي المنازل من نطاق تطبيق قانون العمل، الأمر الذي لا يجعل من الممكن تطبيق أي حكم من أحكام قانون العمل على مستخدمي المنازل عندما يتضمن هذا القانون أحكاما تفضيلية. في حين تهدف الاتفاقية الدولية إلى المساواة بين العمال العاديين ومستخدمي المنازل، على أن يطبق القانون الخاص بهم عليهم بما يحقق مصلحة لهم لا تتحقق في قانون العمل الذي يجب أن يظل الشريعة العامة.
التوصيات: توصي الدراسة المشرّع القطري بتبني الاتفاقية الدولية رقم 189، أو على أقل تقدير تبني أحكاما أكثر منها، بحيث يقترب أكثر من مبدأ المعاملة المتساوية.
