الحماية القانونية للعمال البحارة في ضوء التشريع الأردني ومعايير العمل الدولية

الأهداف: تهدف هذه الدارسة إلى بيان مفهوم العامل البحري، والمقصود بعقد العمل البحري وطبيعته القانونية، وبيان أبرز الحقوق التي يتمتع بها العامل البحري والآليات التي تساهم في حماية حقوقه، والتعرف إلى مدى كفاءة التشريعات الأردنية؛ لتعزيز حقوق العامل البحري، وتوفير بيئة عمل لائقة له، ومدى انسجامها مع معايير العمل الدولية.
المنهجية: اتبع الباحث في هذه الدراسة المنهج الوصفي والتحليلي؛ فالمنهج الوصفي القائم على وصف الأحكام القانونية الناظمة للعامل البحري، وعقد العمل البحري، أما المنهج التحليلي فمن خلال تحليل النصوص القانونية في قانون التجارة البحرية، وقانون العمل مستعيناً في ذلك باجتهاد الفقه القانوني والاجتهاد القضائي، ومقارنتها بمعايير العمل الدولية المعتمدة من قبل منظمة العمل الدولية.
النتائج: لقد توصلت هذه الدراسة إلى عدد من النتائج منها، أن عقد العمل البحري يخضع لأحكام قانون العمل في الحالات التي لم ينص عليها قانون التجارة البحرية، بالإضافة إلى أن تنظيم المشرع الأردني لعقد العمل البحري قد خلق إشكاليات قانونية منها عدم تضمين تعريف العامل البحري للعناصر الأساسية لعقد العمل البحري.
الخلاصة: إعادة النظر بالتشريع الذي يحكم عمل العامل البحري بما ينسجم مع معايير العمل الدولية وخاصةً اتفاقية العمل البحري، وكذلك مع قانون العمل النافذ حتى يواكب تطورات قطاع النقل البحري.
