The Rules of the ‘Decisive’ Oath: A Comparison between the Jordanian Evidence Law and Islamic Jurisprudence

Objectives: To compare the rules of decisive oath in the Jordanian legislation to that of Islamic Jurisprudence, along with proposing amendments that are consistent with the principles of the Islamic judiciary.
Methods: The study examined the texts of Jordanian legislation in particular, and the entirety of Arab legislation in general, and compared these legislative texts to the texts of jurisprudence Madhhabs. The study analyzed the legislative texts and examined the extent to which the law agrees with Islamic jurisprudence.
Results: Mostly, the decisive oath provisions are in agreement with the provisions of Islamic jurisprudence, except that the Jordanian law, similar to other Arab laws, stipulates that the decisive oath or refraining from it, respectively, resolves the dispute in favor of the taker or permanently dismisses it against the favor of the refrainer, and that who asked for the oath does not have the right to sue again the offeror in contrast with the broadness of Islamic jurisprudence allowing the submission of evidence even after making the oath. It has also been found that the legal legislation that is inconsistent with the provisions of Islamic jurisprudence originating from European legislation.
Conclusions: Proposing some amendments to the legislation of the decisive oath in accordance with Islamic jurisprudence.
