Abstract

Objectives: This research aims to state the role of cooperative insurance in capital preservation and to protect it from risks, including the risk of encroaching on the investment administrator. It also determines the consequences of the investment administrator's deliberate infringement or negligence under the pretext of the existence of cooperative insurance.

Methods: The inductive, analytical, and comparative approach is adopted in order to track and analyze the issue from all its sides in a comparative way that makes it easy to accurately describe them, to reach results that accurately show the limits of the issue and its place in the system of legitimate provisions.

Results: This research has reached the following results such as cooperative insurance is one of the means of protecting the capital of investments. Cooperative insurance from the contract responsibility of the investment administrator encourages investment and does not treasure funds for fear of high investment risk. Also, cooperative insurance, although it is obliged to compensate the owner of the money, does not exempt the investment manager from the guarantee in the event of intentional infringement or negligence, so he is responsible for what was paid to the owner of the money.

Conclusions: Need to conduct more research in this topic due to lack of previous literature on it. Amendment of the word "legal standards" in the paragraph referred to in relation to the insurance applicant, for the financial obligations and another form of insurance on which it is based.
