Objectives: Restorative justice can serve as a key mechanism of transitional justice in Syria, aiming to ensure a smooth and sustainable transition. It operates within a balanced framework that seeks both security and stability, as well as the protection of victims’ rights. However, it faces major challenges, including the lack of legal frameworks and the influence of sectarianism and extremism. This study first introduces the concept and foundations of restorative justice, then examines its role in balancing victims’ rights with societal stability in Syria.
Method: The study adopts a descriptive and analytical approach to address the research problem. It begins with describing restorative justice and its theoretical foundations, then analyzes its potential to balance redress for victims with sustainable peacebuilding, while also examining the major challenges it faces in the Syrian context.
Results: The study demonstrates that restorative justice is an urgent necessity for achieving security and stability in Syria, as it plays a crucial role in balancing victims' rights with sustainable peacebuilding. However, the lack of legal frameworks to support restorative justice and the widespread presence of sectarian and extremist ideologies pose significant obstacles to its success. This calls for the adoption of a comprehensive participatory approach, including legislative and institutional reform, reparation programs, and rehabilitation initiatives.
Conclusion: The study concludes that awareness campaigns and programs are essential to promote the importance of restorative justice in building a culture of civil peace and ending conflict. It also recommends the adoption of reform, reparation, rehabilitation, and socioeconomic development programs to ensure the sustainability of peace in Syria.
