Abstract

Objectives: This study aims at setting a maxim and an adequate standard for preponderance in controversial matters of obligatory orders, namely, interest. Past and current studies have not paid attention to this standard or tracked it independently despite its importance. The study also aims at gathering all matters of obligatory orders that share the same approach about interest, setting them under one rule, then looking into each order and the interest benefited therefrom, and elaborating the reason for preponderance and its evidence.

Methods: The study follows two methodologies: the inductive methodology through scrutinizing the mathaahib's views in each matter, stating some of their interest-related proofs, and the analytical methodology through analyzing fundamental scholars' statements in relation to matters outlined in this study, demonstrating the mechanism of putting interest into effect as an adequate preponderant.

Results: Employing interest as a preponderant is more fitting and more standardizing than other preponderant since it addresses each act solely concerning its nature, magnitude, time, and generality since all acts are not the same degree regarding interest and benefit. Furthermore, employing such preponderant is subject to specific regulations and evidence, not absolute.

Conclusions: The study concludes that the necessity of considering interests in matters of obligatory orders, especially in Ijtihad and Fatwa, so that Ijtihad is proper and Fatwa is accurate, appropriate, fair, and free of extremism, hardship, and uncontrolled.
