الترجيح في مسائل الأمر بمراعاة المصلحة: دراسة أصولية مقاصدية

الأهداف: تهدف هذه الدراسة إلى وضع ضابط ومعيار مناسب للترجيح في مسائل الأمر التي حصل فيها خلاف، وهو ضابط المصلحة؛ فالدراسات القديمة والمعاصرة لم تلتفت لهذا الضابط وتعتني به استقلالا مع أهميته، كما تهدف إلى جمع مسائل الأمر التي تتشابه في ذات الوجه من جهة المصلحة، وتصنيفها تحت حكم واحد، والنظر في كل أمر على حده، وما يتحصل منه من مصلحة، وبيان وجه الترجيح وأدلته.
المنهجية: اتبعت الدراسة نوعين من المناهج: المنهج الاستقرائي، باستقراء أقوال المذاهب في كل مسألة، وذكر بعض أدلتهم ما تعلق منها بالمصلحة، والمنهج التحليلي، بتحليل آراء علماء الأصول في المسائل المعروضة في البحث، وبيان آلية تفعيل المصلحة في كل أمر حتى تصلح أن تكون مرجحا مناسبا.
النتائج: توصل البحث إلى جملة من النتائج، منها: أن العمل بالمصلحة كمرجح هو أنسب وأضبط من غيره من المرجحات، فهو يراعي كل فعل على حده من حيث طبيعته وحجمه ووقته وعمومه، فالأفعال ليست كلها على درجة واحدة من المصلحة والنفع الحاصل منها، وأن العمل بهذا المرجح له ضوابطه وأدلته وليس مطلقا.
الخلاصة: ضرورة الالتفات إلى المصالح في مسائل الأمر لاسيما في الاجتهاد والفتوى، حتى يكون الاجتهاد سليما، وتكون الفتوى صحيحة ومناسبة وعادلة وبعيدة عن الغلو والعسر وعدم الانضباط.
