Mufti’s Devotion and its Impact on the Fatwa "A Practical Fundamental Study"

Abstract

This research deals with the impact of the mufti's devout opinion on the fatwa, reviewing the legitimacy of the Prophet Hadith peace be upon him, and how fundamentalist scholars and jurists have been pious about their fatwas and that the mufti when he is exposed to the question of suspicion, it is presented in the tradition of the most diligent and then the most righteous, If two of the people of the fatwa meet, one of them is pious and the other is aware, he asks the pious of the two worlds. The researcher found that the Mufti must be when the suspicion occurs and do not distinguish between conflicting evidence out of the dispute, or take the precaution, or stop in the fatwa, the research concluded to a set of results, the most important of which is that the fatwa in piety is not out of weighting and doctrinal choice, and that this pious effect on the application of jurisprudence as shown by the applied models. The researcher recommends the need to study this subject thoroughly, and link it to some practical issues that show the difference of scientists in the consideration of the fatwa.
