Lafif Testimony of Istir’aa: A Comparative Jurisprudential Study

Objectives: This study aimed to trace the emergence of the Lafif testimony of invocation and show its essence and explain how valid it is. The study also investigates the terms and regulations surrounding this testimony and present the impediments and dillemmas related to this kind of testimony and offer few suggested solutions to create a jurisprudential system to regulate it.
Methods: The research adopts an analytical methodology by analyzing texts and issues related to the testimony of a Lafif expert witness to benefit from them in addressing the issues raised in this study. Additionally, a comparative approach is utilized by comparing the rulings of Islamic jurisprudence with the regulations of positive laws related to the subject of this research. Furthermore, the research follows an inductive methodology in determining the meaning of the Lafif witness testimony, adapting it legally, and providing a precise scientific description.
Results: The research concludes that lafif witness testimony can be applied in various fields, including personal status matters and others, but it is not applicable in cases of murder due to the possibility of doubt, which precludes the application of retribution. A prevalent challenge is the misuse and forgery of Lafif witness certificates, as well as lax procedures for receiving them without prior judicial authorization.
Conclusions: The study recommends highlighting the the need for legislative regulation Lafif witness certification, highlighting the legislative vacuum as a significant challenge. Moreover, it strongly advocates restricting the use of Lafif witness testimny a means of proof only in cases of extreme necessity and with precise delineation of such cases.
