الملخص

الأهداف: تسعى الدراسة إلى تحليل التغيرات التي تطرأ على الحقوق والواجبات الزوجية بعد اكتساب الزوجة الأجنبية لجنسية زوجها الأردني، ومدى انعكاس ذلك على العلاقة بين الزوجين، وحضانة الأبناء، والنفقة، والمواريث. كما تهدف إلى بيان مدى المساواة بين الزوجة المتجنسة والزوجة الأردنية الأصل في إطار قانون الأحوال الشخصية، واستعراض الآثار القانونية المترتبة على هذا التجنّس.

المنهجية: اعتمدت الدراسة المنهج الوصفي التحليلي، من خلال دراسة النصوص القانونية ذات العلاقة في قانون الأحوال الشخصية الأردني وقانون الجنسية، بهدف توضيح الجوانب القانونية المرتبطة بتجنّس الزوجة الأجنبية. كما تم التركيز على مدى تحقق المساواة بينها وبين الزوجة الأردنية الأصل من حيث الحقوق والواجبات.

النتائج: تشير النتائج إلى تعدد طرق اكتساب الجنسية الأردنية، وأبرزها التجنّس عن طريق الزواج المختلط ضمن شروط حددها القانون. ويترتب على اكتساب الزوجة الأجنبية للجنسية الأردنية تمتعها بكامل الحقوق والواجبات، ومساواتها بالزوجة الأردنية الأصل فيما يتعلق بالحياة الزوجية، والحضانة، والإرث، وغيرها من الحقوق المرتبطة بالعلاقة الأسرية.

الخلاصة: توصي الدراسة بضرورة تبسيط إجراءات الحصول على الجنسية الأردنية، وتعزيز مبدأ المساواة بين جميع المستحقين لها، بما يسهم في ترسيخ قيم المواطنة والعدالة داخل المجتمع.
