تعويض ضحايا حوادث المرور عن ضررهم المهني والاقتصادي: دراسة مقارنة

الملخص

الأهداف: تهدف هذه الدراسة لتسليط الضوء على قانون التأمين الفلسطيني رقم (20) لسنة 2005، ومجلة التأمين التونسية رقم (86) لسنة 2005، ومدى تحقق الهدف المعلن للمشرع والمتمثل بإقرار نظام جديد يقوم أساساً على ضوابط موضوعية تكفل تحقيق التعويض المنصف لكافة المتضررين من حوادث المرور.

المنهجية: اعتمدت الدراسة المنهج المقارن والتحليلي لنصوص قانوني التأمين الفلسطيني والتونسي، وقرارات محكمة النقض الفلسطينية ومحكمة التعقيب التونسية.

النتائج: توصلت الدراسة إلى أن النصوص القانونية انحازت لدعم المؤمن على حساب المؤمن له في عدد من المحاور ولعل أبرزها الكيفية التي يتم من خلالها تعويض ضحايا حوادث المرور عن ضررهم المهني. ونجد كذلك أن قانوني 2005 الفلسطيني والتونسي لم تنظم نصوصهما حق التعويض لكل من تضرر ماديا أو معنويا جراء وفاة المؤمن له بحادث مرور. إذ أن حصر قائمة المستحقين للتعويض بقائمة محددة هي وحدها المستحقة للتعويض عن الضرر المادي والمعنوي المرتد عليها من وفاة المصاب في حادث المرور، سواء في مجلة التأمين التونسية أو قانون التأمين الفلسطيني أدى لمخالفة أحد أهداف قانوني 2005 والمتمثلة في توسيع نطاق تغطية تعويض المتضررين جراء حادث المرور.

الخلاصة: لم يتم تحقيق أحد أهداف قانوني 2005 والمتمثلة في توسيع نطاق تغطية التعويض من خلال إعمال إقرار الحق في التعويض العادل لكل متضرر جراء حادث المرور.
