دوائر الجلسة الواحدة - دراسة تحليلية - في ضوء قانون الإجراءات المدنيّة الإماراتي الاتحادي ولائحته التنظيميّة

الأهداف: يهدف هذا البحث إلى دراسة أحكام دوائر الجلسة الواحدة أو ما يسمى مجازاً "محكمة اليوم الواحد"، التي استحدثها المشرع الإماراتي مؤخراً؛ للمساهمة في حل مشكلة البطء في إجراءات التقاضي.
المنهجية: اعتمد البحث المنهج الوصفي والتحليلي وذلك من خلال تحليل الطبيعة القانونية لدوائر الجلسة الواحدة من خلال مراجعة الدعاوى التي تعرض عليها.
النتائج: خلص البحث إلى مجموعة من النتائج، من أهمها: أن الدعوى قبل عرضها على الدوائر موضوع البحث، لابد وأن يتم تحضيرها من قبل مكتب إدارة الدعوى، وأن الفصل فيها من قبل الدائرة المختصة، يتم في جلسة واحدة فقط، بحكم منهٍ للخصومة توضع أسبابه في ملف الدعوى في ذات الجلسة، ويكون قابلاً للطعن فيه بطريق الاستئناف، وحكم الاستئناف يخضع بدوره للطعن بطريق النقض إن توفرت شروطه.
الخلاصة: النص على استحداث نوع آخر من المحاكم الابتدائية وتُسميته "محاكم الجلسة الواحدة" إلى جانب المحاكم الجزئية والمحاكم الكلية، عوضاً عن دوائر الجلسة الواحدة، وإنقاص ميعاد الاستئناف بالأحكام التي تصدر عنها إلى الحد الذي يأتلف مع الغرض من استحداثها.
