إطار التجديد في الفتاوى المتعلقة بنظام الأسرة من خلال قاعدة "المشقة تجلب التيسير"

الأهداف: يهدف البحث إلى تنظيم العمل الإفتائي بما يخدم المستجدات المرتبطة بنظام الأسرة، ضمن قاعدة المشقة تجلب التيسير، إذ تشكل الفتوى أرضاً خصبة في تطبيقاتها المرتبطة بنظام الأسرة من خلال القواعد الفقهية والمقاصدية التي تدور في فلك قواعد رفع الحرج و الاشارة الى الحاجة للتجديد في صناعة الفتوى بما يتماشى مع الواقع، بفهم مقاصدي يرتكز على أركان الشريعة ويسهم في تخفيف مشاكل وأعباء الأسرة، ويرفع الحرج عن ظروفها ويحقق استقرارها، دون فقدان هوية الإسلام في صورته السمحة.
المنهجية: اعتمدت الدراسة المنهج الوصفي التحليلي، من خلال جمع البيانات والمعلومات لإبراز أهمية الإطار التوجيهي للفتوى، والربط بين المعطيات والأسئلة لإيجاد الحلول للإشكاليات المتصلة بالأسرة بما يكسبها صفة المرونة وتذليل العقبات من خلال قاعدة "المشقة تجلب التيسير"، واستخراج النتائج لتطبيقات الفتاوى المتعلقة بهذه القاعدة في مسائل الأسرة من خلال قانون الأحوال الشخصية الأردني.
النتائج: تعد قاعدة "المشقة تجلب التيسير" من أبرز القواعد المتصلة بتطبيق صناعة الفتوى في النظام الأسري ضمن مجالاته القانونية والاقتصادية والتربوية، ومن خلال ارتباط القاعدة بقواعد أخرى لرفع الحرج، وهذا يستلزم تأهيل المفتين في صناعة الفتوى المعاصرة، من خلال الاستعداد للنوازل قبل وقوعها.
الخلاصة: عقد الورشات ومجالس الإفتاء والمؤتمرات لتأهيل المفتين، وتطوير أدائهم لمواكبة المستجدات على كافة الأصعدة.
