حدود الحصانة النيابية المقررة لأعضاء مجلس الأمة الأردني في التشريعات الأردنية

تناولت هذه الدراسة نطاق وحدود الحصانة الموضوعية والاجرائية المقررة لأعضاء مجلس الأمة الأردني وفقا لأحكام الدستور. وقد أبانت الأحكام القانونية أن الحصانة الموضوعية محدودة بإبداء الرأي والأقوال داخل قبة البرلمانية. كما حددت الحصانة الاجرائية فقط أثناء انعقاد مجلس الأمة التي تقتضي أخذ إذن المجلس لغايات التوقيف والمحاكمة في حال ارتكاب عضو مجلس الأمة جريمة جنائية. وتنطلق مشكلة الدراسة من حيث اللغط في اطار التفسير المتباين لنطاقها مكانيا وزمانيا، وتعارض بعض أحكام النظامين الداخلين لمجلس النواب والاعيان مع أحكام الدستور فيما يتعلق بتوسيع نطاق ومشتملات الحصانة. استخدمت الدراسة المنهج الوصفي المرتكز على تحليل النصوص القانونية لتحقيق أهداف الدراسة. وقد خلصت الدراسة إلى جملة من النتائج والتوصيات، ولعل أهمها توسع النظام القانوني والقضاء الأردني في نطاق الحصانة زمانيا بحيث تشتمل على الأفعال المرتكبة قبل اكتساب العضوية البرلمانية، كما رأينا وجوب اجراء تعديل دستوري على المادة (86) بحيث تسري الحصانة على كافة الجرائم الجنائية بحيث تشمل الجنح والمخالفات دون اقتصارها على الجنايات فقط.
