النقض المكسور عند الأُصوليين

الكسر واحد من قوادح العلّة عند الأُصوليين، وله معنيان، يختصّ أوّلُهُما بالعلل المركّبة؛ حيث يقوم المعترض بإلغاء بعض العلّة وإزالة تأثيره، وينقض بعضَها الآخر، فإذا قام بهاتين الخطوتين فقد كَسَرَ العلّة، بمعنى أنه قدح فيها أو هدمها، وهذا بدوره يُبطل العملية القياسية التي بناها المستدل؛ لأنّ هذه العملية تقوم على العلّة التي هُدمت. أما المعنى الثاني فهو ما ذكره الأُصوليون بأنه تخلّف الحكم عن الحكمة. وتهتم الدراسة بالمعنى الأول للكسر الذي أطلق عليه العالم الأُصولي الآمدي اسم "النقض المكسور"، واستحسنه الأُصوليون بعده. تبنت الدراسة منهج الاستقراء الناقص إذ يتعذر الاستقراء التام، والناقص كافٍ فيما يحتاجه البحث، كما استخدم المنهج المقارن بين الأقوال. توصلت الدراسة الى ان هناك معنيين للكسر. الاول الذي يسعى إلى هدم العلّة المركّبة من وصفين، فبعد أن يقوم بتفكيكها يقدح في الوصف الأول بعدم التأثير ويسميه الأُصوليون هنا الإلغاء، وفي الوصف الثاني بالنقض، ولعل أقرب تعريفات الأُصوليين له هو تعريف السبكي. الثاني الساعي إلى هدم العلّة الأحادية في أغلبه، وهو في حقيقته نقض لكنه يَرِدُ على الحكمة لا على العلّة.
