تقويم أداء الموظف العام في القانونين الأردني والإماراتي: دراسة مقارنة

تلجأ الإدارة العامة إلى تقويم أداء الموظفين العموميين بشكل دوري، من خلال تقارير تقويم الأداء سواء أسنوية كانت أم نصف سنوية أم ربع سنوية، ويترتب على هذه التقارير بعد اكتسابها الدرجة القطعية آثار مهمّة، سواء بالنسبة إلى الإدارة العامة أم بالنسبة إلى الموظف العام على حدّ سواء، وقد لجأ المشرع إلى إحاطة هذه التقارير بالعديد من الضمانات لتحقيق أهدافها. ولكي تكون الصورة وافية وواضحة عن تقويم الأداء في النظام القانوني الأردني والإماراتي اتبعت الدراسة المنهج القانوني المقارن، مع استخدام منهج البحث الوصفي التحليلي للنصوص القانونية ذوات العلاقة. وبعد تسليط الضوء على تقويم الأداء الوظيفي في كلاً من القانونين الأردني والإماراتي توصلت الدراسة لمجموعة من النتائج والتوصيات التالية. لم يجز المشرع الأردني التظلم من تقارير الأداء إلا عندما يكون التقدير (ضعيفًا)، وكذلك المشرع الإماراتي فلم يجز التظلم من تقارير الأداء إلا عندما يكون التقدير (بحاجة إلى تحسين) وهذا يعنى أن الموظف الذي يحصل على تقدير (جيد جدًا) أو(جيد) أو (متوسط) في القانون الأردني و(يفوق التوقعات) أو (يلبي التوقعات) لا يستطيع التظلم منه. أوصي الباحث بضرورة دعوة المشرع في كلاً من الأردن والإمارات إلى ضرورة النص على منح الموظف ضمانة في التظلم من تقارير تقويم الأداء الوظيفي.
