تعليق التعليق في الفقه الإسلاميّ

يتغيّا هذا البحث دراسة أسلوب تعليق التعليق في الفقه الإسلاميّ. حيث يكشف عن معناه المتمثّل في اعتراض الشرط على الشرط، وبعبارة أوضح: ارتباط وقوع الجواب بحصول شرطين أو أكثر، ومثاله قول القائل:"إنْ دخلت، إنْ كلّمت زيدًا، فأنت طالق". فأبان البحث صحّة هذا الأسلوب عند جمهور النحاة، وكافّة الفقهاء. وعرض البحث إلى أدلّة الفقهاء في تصحيح هذا الأسلوب، وخلافهم في دلالته الفقهيّة. وأظهر البحث أدلّة الفرقاء، مع مناقشتها، وتحقيق القول الراجح منها، مع أدلّته. اعتمد البحثُ المنهجَ الاستقرائيّ للتوصّل إلى معاني أسلوب تعليق التعليق. وانتهى البحث إلى أنّ الراجح من كلام الفقهاء، أنّ الجواب يقع بحصول مجموع الشرطين، وفق ما يقتضيه المعنى الصحيح. كما توصّل البحث إلى إنّ تطبيقات تعليق التعليق، في الفقه الإسلاميّ، قليلة جدًا، جارية في باب الإيلاء والطلاق والعتق. توصل البحث ايضا أن المذهب الشافعيّ كام من أكثر المذاهب الأربعة تفصيلًا في قضايا تعليق التعليق. وكان من توصيات البحث تخصيص رسالة ماجستير حول أدوات التعليق وأثرها في الفقه الإسلاميّ.
