تتناول هذه الدراسة مدى انطباق قواعد عدم الصلاحية والرد والتنحية على قضاة محاكم القضاء الإداري في الأردن وفرنسا، وقد أبرزت الدراسة مدى مؤامة وملائمة تطبيق حالات عدم الصلاحية والرد والتنحية المنصوص عليها في قانون أصول المحاكمات المدنية الأردني على قضاة محاكم القضاء الإداري، وبيان الجهة المختصة للنظر في طلب رد القاضي الاداري وإجراءات تقديم طلب الرد، وتكمن إشكالية الدراسة في عدم تنظيم المشرع الإداري الأردني حالات عدم صلاحية ورد وتنحية قضاة محاكم القضاء الإداري، وقد تصدت الدراسة إلى الإجابة عن جميع التساؤلات التي أثيرت حول عدم الصلاحية والرد والتنحية، وَخَلُصت إلى عدة نتائج وتوصيات، من أهمها ضرورة إرساء نظام ازدواج القضاء في الأردن من خلال السير على خطى التنظيم القضائي في فرنسا، ورجوع المحكمة الدستورية الأردنية عن قراراها التفسيري التي اعتبرت المحاكم الإدارية جزءًا لا يتجزأ من القضاء النظامي، وإفراد نصوص خاصة في صلب قانون القضاء الإداري لمعالجة أسباب عدم الصلاحية والرد والتنحية، مثلما هو متبع في قانون القضاء الإداري الفرنسي، وميثاق أخلاقيات القضاء الإداري الفرنسي لأهمية القضاء الإداري الذي يهدف إلى ضمان تحقيق مبدأ المشروعية.
