تسعى الدول الديمقراطية جاهدة إلى تجسيد مبدأ نزاهة الانتخاب بوسائل عدة، ومنها ما يتعلق بالجهة المشرفة على العملية الانتخابية، وتحديد الجهة المختصة بالفصل في صحة العضوية بحيث يكون تعبيرًا حرًا عن إرادة هيئة الناخبين. وتظهر مشكلة الدراسة من حيث الكشف مدى اتساق تحديد الجهة المختصة بالفصل في صحة العضوية وانعكاساتها على نزاهة الانتخاب من عدمه. اعتمدت الدراسة المنهج القانوني المرتكز على ممازجة الطريقة الوصفية بالطريقة التحليلية القائم على تحليل النصوص القانونية ذات العلاقة بموضوع الدراسة مستندين على الأحكام القضائية والآراء الفقهية ذات العلاقة بالموضوع. وقد خلصت الدراسة إلى مجموعة من النتائج: اولا، أن الواقع العملي في ممارسة الفصل في صحة عضوية أعضاء مجلس النواب الأردني قبل تعديل الدستور عام 2011 يشير إلى عدم جدوى وفاعلية تلك الممارسة؛ لعدم توافر الحيادية المطلوبة في هذا الاختصاص. ثانيا، التحول الايجابي في إسناد الفصل في صحة العضوية من المجلس النيابي إلى القضاء ممثلا بمحكمة الاستئناف، وانعكاسه على نزاهة العملية الانتخابية. توصي الدراسة بإسناد هذا الاختصاص إلى القضاء الإداري على اعتبار أن طبيعة الطعون بالفصل لا تخرج عن كونها بطبيعتها القانونية منازعة قانون عام.
