أثر فرار الموظف العام من وجه العدالة في التشريع الأردني: دراسة مقارنة

تناول الباحث آثار فرار الموظف العام من وجه العدالة في التشريع الأردني والمقارن بأقسام ثلاثة، تناول الأول ماهية الفرار من وجه العدالة، وتناول الثاني صور فرار الموظف العام من وجه العدالة، وتناول الثالث الآثار المترتبة على صدور القرار باعتبار الموظف العام فار من وجه العدالة، وبرزت مشكلة الدراسة بمناقشة الحالة التي يتهم فيها الموظف بارتكاب جريمة من نوع الجناية وفراره من وجه العدالة في أي مرحلة من مراحل التحقيق أو الحكم بالجريمة وأثر صدور قرار توقيف الموظف العام عن العمل لحين بت القضاء بالتهمة المنسوبة إليه، وأثر براءة أو ادانة الموظف العام بالتهم المنسوبة إليه، وقد توصلت الدراسة إلى مجموعة نتائج كان أهمها، عدم تقنين معظم التشريعات المقارنة لهذه الحالة في التشريعات الناظمة للوظيفة العامة، وقد وضع الباحث عدة توصيات كان اهمها ان يقوم المنظم السعودي بتنظيم حالة محاكمة المتهم الفار من وجه العدالة في نظام الاجراءات الجزائية السعودي وتنظيم هذه الحالة في التشريعات الناظمة للوظيفة العامة سواء في المملكة أو في دول القانون المقارن.
