الملخص

الأهداف: هدفت هذه الدراسة إلى بيان أهمية مدى التزام الحنفية بدلالة الخاص، وبيان الفروع الفقهية المبنية على اختلاف الأصوليين، وتوضيح دلالة الأمر والنهي، والأداء والقضاء والمطلق والمقيد، وحروف المعاني، وأهميتها، وضوابطها، ودعوى مخالفتها للأحكام الفقهية.

المنهجية: اتبعت الدراسة ثلاثة مناهج، هي: المنهج الوصفي، والمنهج التحليلي، والمنهج الاستنباطي، وذلك من خلال وصف المسائل الأصولية لدلالة الخاص من كتب الأصوليين، ومعرفة مذاهبهم في كل مسألة من مسائل البحث مع توثيقها، من ثم تحليل الأقوال وتحريرها، واستنباط النتائج المتعلقة بموضوع الدراسة.

النتائج: توصلت الدراسة إلى جملة من النتائج أهمها: التزم الحنفية بدلالة الخاص على مدلوله كونه واضحا في نفسه ولا يحتاج إلى بيان، وأن الخاص لا يزاد عليه بخبر الواحد ولا بالقياس، والقضاء ثبت بما ثبت به الأداء، والمطلق لا يحمل على المقيد إلا للضرورة، وأن دلالة أحرف المعاني قطعية على مرادها.

الخلاصة: عدم الاكتفاء بالنظر في كتب الفروع الفقهية والاستدلال بالأدلة الجزئية فقط، والالتزام بدراسة القواعد الأصولية عند النظر في محل الخلاف الفقهي.
