السلطة التقديرية للقاضي وأثرها في دعاوى المحاكم الشرعية الأردنية: دراسة تأصيلية تطبيقية

الأهداف: تهدف الدراسة إلى بيان السلطة التقديرية للقاضي الشرعي، وأثر هذه السلطة في دعاوى المحاكم الشرعية الأردنية، وقد جاءت هذه الدراسة لإبراز هذه السلطة، ولتؤكد على أن آثار هذه الأحكام هي الثمرة المرجوة من كل إجراءات التقاضي، إذ إن تأثيرات الحكم لها دور عظيم في شعور الناس بالثقة والاطمئنان، والأمن من الخوف، والركون إلى العدل، ولذا فقد أوردت الدراسة تطبيقات متعددة ومتنوعة لتكون مثالا صادقا على آثار تلك الأحكام على الدعاوى التي أقيمت.
المنهجيّة: اتبعت الدراسة المنهج الاستقرائي، وذلك بجمع المادة العلمية من كتب الفقه وأصول المحاكمات الشرعية القديمة والحديثة، والمنهج التحليلي، وذلك بتحليل المادّة العلميّة والاستفادة منها في موضوعات الدراسة.
النتائج: توصلت الدراسة إلى أنّ نطاق إعمال السلطة التقديرية للقاضي الشرعي ثابت بنص قانون أصول المحاكمات الشرعية الأردني في العديد من المواضع، والتي أشارت إليها صراحة وضمنا في مواطن عدة، وأهم ما يترتب على ذلك وجوب الالتزام بحكم القاضي، ويجب تنفيذه حالا وقت صدوره إذا كان موافقا للأصول الشرعية واكتسب الدرجة القطعية.
الخلاصة: وجوب إيلاء السلطة التقديرية للقاضي الشرعي مزيدا من الاهتمام من قبل واضعي القوانين المختلفة بالدراسة، بحيث تصبح هذه السلطة واضحة ومحددة بنصوص مضبوطة لا يجوز إغفالها في التقاضي وإجراءاته.
