الأهداف: تهدف هذه الدراسة التي جاءت في مقدمة ومطلبين، إلى بيان ماهية سلطة الإرجاء الممنوحة إلى مجلس الأمن وشروطها ونطاقها والآثار المترتبة على إيقاف التحقيق أو المقاضاة للحالات والقضايا المنظورة من قبل المحكمة الجنائية الدولية.
المنهجية: استخدمت الدراسة عدة مناهج، هي المنهج الوصفي التحليلي الذي ينطلق من وصف الحالة موضع الدراسة، من حيث بيان مفهوم الإرجاء كسلطة ممنوحة إلى مجلس الأمن وبيان شروطه وأهم الآثار المترتبة على استخدامه.
النتائج: إن ممارسة مجلس الأمن لسلطة إرجاء التحقيق أو المقاضاة مستندا إلى الصلاحيات الممنوحة له لتحقيق السلم والأمن الدوليين يعد تدخلا في الاختصاصات القضائية للمحكمة الجنائية الدولية وانتهاكا لاستقلاليتها ومعرقلا لعملها الذي يهدف إلى منع الافلات من العقاب، وتحقيق العدالة الجنائية الدولية.
الخلاصة: ضرورة إجراء التعديلات اللازمة على ميثاق الأمم المتحدة وعلى النظام الأساسي للمحكمة الجنائية الدولية، لإعادة التوازن بين مصلحة الحفاظ على السلم والأمن الدولي، وتحقيق العدالة الجنائية الدولية، ومنع الإفلات من العقاب.
