الرقابة الجمركية على البضائع بين الوظيفة الحمائیة وتيسير حركة التجارة الدولية: دراسةً تحليليَّةً في قانون الجمارك الأردني

الملخص

الأهداف: التطرق لمفهوم وطبيعة الرقابة الجمركية، إذ يقع عاتق الجمارك مهمة التوفيق بين التسهيلات الجمركية بهدف تشجيع الاستثمارات، وزيادة التنافسية من جهة، وحتمية الرقابة من جهة أخرى، ومناقشة تأثير الرقابة الجمركية على التجارة الدولية، خاصة في ظل التحرير الكامل للتجارة الخارجية، وانضمام الأردن للمنظمة العالمية للتجارة.

المنهجية: سنعتمد في إعداد هذه الدّراسة على المنهج الوصفي التحليلي، حيث تم تحليل مجموعة من النصوص التشريعية المحلية المتعلقة بذات الإجراء.

النتائج: إن الدور الرقابي الذي تلعبه دائرة الجمارك لا يقتصر على محاربة الجرائم الماسة باقتصاد الدولة، بحيث تهدف إلى تحقيق موازنة بين التسهيلات الجمركية، وحتمية الرقابة التي تضمن تحصيل الرسوم الجمركية، وضبط مختلف الجرائم الجمركية، ومع تثمين مختلف الأحكام الناظمة لإجراء الرقابة الجمركية، إلا أنه من الضروري إصدار نصوص تنظيمية جديدة تتوافق مع التنظيم الإداري الجمركي وحركة التجارة العالمية.

الخلاصة: الرقابة الجمركية لا تحقق غرضاً في ذاته؛ بل إنها تخدم في ذات الوقت أكثر من غرض، وتحقق عدّة غايات، وهذا هو الواقع المألوف نظراً لتشابك مصالح الدولة، وارتباط كل منها بالآخر.
