الحضور والغياب في الدعاوى القضائية الحقوقية في قانون أصول المحاكمات المدنية الأردني

الأهداف: هدفت الدراسة إلى بيان الضوابط القانونية الناظمة لحضور وغياب الخصوم في الدعوى القضائية الحقوقية سواء كان الحضور شخصياً أو بواسطة محامٍ بموجب وكالة منظمة وفق الأصول، كما هدفت إلى بيان اختلاف الآثار القانونية المترتبة على إجراءات سير الدعوى القضائية الحقوقية في حال حضور أو تخلف كل أو بعض أطراف الدعوى الحقوقية.
المنهجية: اتَّبع الباحث المنهج الوصفي التحليلي؛ وذلك بتحليل النصوص القانونية المنظمة للموضوع، والنصوص الأخرى ذات العلاقة، والاجتهادات القضائية المتعلقة به مستعيناً بالفقه الإجرائي عامةً والأردني على وجه الخصوص.
النتائج: توصلت الدراسة إلى أنَّ تخلف كل أو بعض الأطراف عن حضور الجلسات لا يمنع المحكمة- غالباً- من متابعة السير في الدعوى، وإصدار حكم فيها، وأنَّ أهم الجزاءات الإجرائية المترتبة على تخلف كل أو بعض أطراف الدعوى تتمثل في إسقاط الخصومة.
الخلاصة: خلصت الدراسة باقتراح الباحث تعديل نص المادة (67) من قانون أصول المحاكمات المدنية ببيان نوع الإسقاط، وما إذا كان إسقاطاً مؤقتاً أم إسقاطاً نهائياً، ومراجعة المادة (12) من نظام رسوم المحاكم بتخفيض الرسوم المطلوبة عند تجديد الدعوى المسقطة.
