الحمايتان الدستورية والجنائية لحقي الطمأنينة وخصوصية المصابين بفيروس كورونا من مستخدمي وسائل التواصل الاجتماعي في التشريع الأردني

الأهداف: تهدف هذه الدراسة إلى بيان مدى حماية النظام القانوني الأردني، لحقي الطمأنينة والخصوصية للمصابين بفيروس كورونا من مستخدمي وسائل التواصل الاجتماعي من ناحية دستورية وجنائية.
المنهجية: اتبعت الدراسة المنهج التحليلي من خلال تحليل النصوص القانونية المتعلقة بحقي الطمأنينة وخصوصية المصابين بفيروس كورونا من مستخدمي وسائل التواصل الاجتماعي في الدستور الأردني، وقانون الدفاع، وأوامر الدفاع ذات العلاقة.
النتائج:توصلت الدراسة إلى عدة نتائج، منها: إن أمر الدفاع رقم (8) لسنة 2002 لم يشترط لتحريك الدعوى الجزائية في جريمة نشر البيانات التي تتعلق بخصوصية مرضى كورونا وجود شكوى، وكذلك تمتد حماية الحق في خصوصية المرضى حتى ولو تم المساس بهذا الحق في الفضاء الإلكتروني، إذ أن أمر الدفاع الأردني رقم(8) لسنة 2020 جرّم في البند الثاني منه أفعال نشر البيانات المتعلقة بخصوصية المصابين بكورونا عبر وسائل التواصل الاجتماعي، وأقر لهذه الأفعال عقوبات جنائية.
التوصيات: أوصت الدراسة بعدة توصيات، أهمها: إدراج نص في أمر الدفاع سالف الذكر يتضمن عدم جواز تحريك الدعوى الجزائية بشأن جريمة نشر البيانات المتعلقة بخصوصية مرضى كورونا إلا بعد تقديم شكوى من قبل المجني عليه.
