الملخص

الأهداف: هدفت هذه الدراسة إلى بيان إمكانية اسناد المسؤولية الجزائية للأحزاب السياسية عن جريمة شراء الأصوات المنصوص عليها في المادة (63) من قانون الانتخاب لأعضاء مجلس النواب رقم (4) لسنة 2022.

المنهجية: اعتمدت الدراسة على المنهج الوصفي والتحليلي؛ بوصف وتحليل النصوص القانونية الناظمة لهذه المسؤولية في قانون العقوبات الأردني، وقانون الانتخاب لمجلس النواب رقم (4) لسنة 2022، وقانون الأحزاب السياسية رقم (7) لسنة 2022، بالاستعانة بالفقه القانوني والاجتهاد القضائي.

النتائج: توصلت الدراسة إلى عدة نتائج أهمها: أن المُشرّع الأردني لم يضًمن في قانون الانتخاب لمجلس النواب رقم (4) لعام 2022 وقانون الأحزاب السياسية رقم (7) لسنة 2022 أية نصوص خاصة بمسؤولية الأحزاب السياسية الجزائية عن جريمة شراء الأصوات، مما يعني خضوعها إلى الأحكام العامة الواردة في قانون العقوبات، وقصور الحماية الجزائية لدى المشرع الأردني عن تجريم كافة صور التأثير على إرادة الناخبين المرتكبة من قبل الأحزاب السياسية كأحد الأشخاص المعنوية الخاصة وضعف العقوبات المقررة لها.

الخلاصة: خلصت الدراسة الى ضرورة وضع نصوص خاصة بمسؤولية الأحزاب السياسية عن جريمة شراء الأصوات بحيث لا تستبعد مسؤولية أمينه العام، أو أعضائه، أو ممثليه، أو عماله إذا ارتكبت الجريمة باسم الحزب السياسي أو بإحدى وسائله، وتعديل قانون الانتخاب واعتبار جريمة شراء الأصوات بوصف الجناية، وتعديل قانون النزاهة ومكافحة الفساد واعتبارها جريمة فساد.
