الملخص

الأهداف: تهدف الدراسة إلى دراسة الأحكام القانونية الخاصة بحق المؤجر في استعادة العين المؤجرة عند إخفاق المستأجر بالتزاماته القانونية المقررة في عقد التأجير التمويلي، وذلك وفقاً للأحكام الواردة في القرار بقانون رقم (6) لسنة 2014 بشأن التأجير التمويلي.

المنهجية: سيتم دراسة موقف القرار بقانون رقم 6 لسنة 2014 بشأن التأجير التمويلي من حق المؤجر في استعادة العين المؤجرة بموجب عقد التأجير التمويلي، وذلك ضمن منهج تحليلي، كما سيتم دراسة موقف القضاء بهذا الخصوص ضمن منهج تأصيلي تحليلي، ودراسة موقف التشريعات الأردنية والمصرية، وآلية تعاملها مع استعادة المؤجر للعين المؤجرة في عقد التأجير التمويلي. وذلك ضمن منهج مقارن.

النتائج: إن المشرع الفلسطيني قد أفرد لعقد التأجير التمويلي أحكاماً قانونية تميزه عن غيره من التعاقدات الأخرى في استعادة العين المؤجرة، كما منح طرفي العقد الحرية التعاقدية للاتفاق على العديد من الأحكام. كما نص على أحكام قانونية خاصة بإجراءات التقاضي لاستعادة العين المؤجرة تتفق وخصوصية هذا النوع من العقود.

الخلاصة: خلصت الدراسة إلى وجود تناقض في الأثر المترتب على هلاك العين المؤجرة في التشريع الفلسطيني، إضافة لوجوب توجيه اشعارين للمستأجرين وفقاً لأحكام القانون يتعلق الأول بالفسخ ويتعلق الثاني باستعادة العين، إضافة لوجوب تنظيم الكفالة المالية المطلوبة من المؤجر بطريقة أوضح.
