Guardian Approval in the Marriage Contract in the Jordanian Personal Status Law 2019 and the CEDAW Convention (Convention on the Elimination of All Forms of Discrimination against Women): A Comparative Study

Objectives: The current study compares the guardian's consent to the marriage contract based on the Jordanian Personal Status Law (JPSL) 2019 with the CEDAW (Convention against all forms of discrimination against women).
Methods: The study adopted an inductive and analytical approach in extrapolating Sharia texts from their sources and analyzing them in light of Islamic Sharia provisions. The texts of laws (Jordanian Personal Status Law and CEDAW Convention) were also used as the subject of study.
Results: The study found that the consent of the guardian is a prerequisite to the validity of a marriage contract in the Jordanian Personal Status Law 2019, contrary to the CEDAW Convention.
Conclusions: The study concluded that the consent of the guardian in the marriage contract has been a major source of controversy in recent years. Laws and agreements have been enacted that permit women to marry without permission from their guardians, which violates Islamic law. These findings led to recommendations on the need to protect Jordanian marriage contracts, in line with the Personal Status Law, from the risks of CEDAW.
