Inference from the Hadith of the Prophet at the Schools of Al-Sham and Al-Kufa: The Two Imams Al-Awza’i and Abu Hanifa as a Model

Abstract

Objectives: This study aims to demonstrate how to use and derive inference of Islamic legal opinions through the Hadith (sayings and actions of the Prophet Muhammad) and its method of inference. It also seeks to uncover the understanding and intent of the Hadith in the schools of Sham and Kufa, as interpreted by the Imams Al-Awza'i and Abu Hanifa.

Methods: Through studying the prominent scholars Al-Awza'i and Abu Hanifa, who represent these two schools of thought, this study examined various legal issues from different chapters of Sahih Al-Bukhari (authentic Hadith collection), and followed the opinions of these Imams in those issues, and how they used the Hadith to deduce Sharia rulings and explain its implications.

Results: The study found that the prophetic Hadith is crucial in deriving legal opinions and choices for the Imams Al-Awza'i and Abu Hanifa, based on their jurisprudential principles and methods of inference, which are based on the Quran, the Sunnah, consensus, and analogy.

Conclusions: The schools of Sham and Kufa are modern schools of thought that base their legal choices and rulings on the Hadith and its inference. The study recommends the importance of exploring other jurisprudential pathways of scholars from different schools of thought and understanding their methods of using the Hadith to derive legal opinions. Additionally, it highlights the need to understand the jurisprudential formation of these scholars through the Hadith.
