The Role of Modern Judicial Notifications Methods in Reducing Court Congestion in Palestinian Courts: The Case of Jerusalem

Objectives: The study aimed to clarify the impact of the existing judicial notification system in Palestine on the accumulation of cases. It also sought to assess the effectiveness of modern notification methods in overcoming legislative and practical challenges faced by the system, particularly in Jerusalem. Additionally, the study aimed to review best practices and relevant models in the laws of comparative countries, with the intention of enriching Palestinian legislation and proposing innovative solutions that can be adopted.
Methods: The study followed a descriptive approach by describing the legal status of the judicial notification system in Palestine. It employed an analytical methodology to analyze relevant legal texts in the Palestinian Law of Civil and Commercial Procedures No. (2) of 2001. This was compared with the legal texts regulating judicial notifications in Jordan and the UAE. Judicial decisions were also consulted whenever possible.
Results: The study found that the adopted notification methods in Palestine contribute to the accumulation of cases in the courts. The presence of Israeli occupation creates practical challenges for the notification system, especially in Jerusalem. To address case accumulation and overcome the obstacles imposed by occupation, it is necessary to learn from the experiences of comparative countries. This involves employing modern judicial notification methods such as using text messages and emails in the Palestinian judicial notification system.
Conclusion: The study recommends amending Article (7) of the Palestinian Civil and Commercial Procedural Law to include provisions allowing judicial notifications through modern electronic means, such as text messages and email.
